2. The Competition

2.1. These terms and conditions govern all competitions featured on the Organiser’s website at https://gaingrind.co.uk (the “Site”).

2.2. All competitions are skill-based competitions. Entry fees for online submissions are required for each entry. Where the Organiser presents a straightforward or multiple-choice question, a free entry option is provided.

2.3. For a chance to win, every individual participating in the competition (an “Entrant”) must correctly answer a question or solve a problem established by the Organiser (the “Competition Question”).

3. How to Participate

3.1. The competition will commence on and include the start and end dates specified on the Site. These dates will be referred to as the “Start Date” and “End Date”, respectively. All dates and times mentioned are those in London, England.

3.2. The Organiser retains the prerogative to alter the Start and End Dates if absolutely necessary. Should the Organiser modify the Start Date and/or the End Date of a competition, the updated information will be displayed on the Site. The End Date will not be extended solely for the purpose of increasing entry numbers.

3.3. All competition entries must be received by the Organiser no later than the stipulated time on the End Date. Any competition entries received after this time on the End Date may be disqualified without any refund.

3.4. The maximum number of entries permitted for the competition will be indicated on the Site. The number of entries you can make may be limited if the maximum entry threshold is reached.

3.5. Entrants are permitted to enter each competition as frequently as they wish, up to the maximum number of entries allowed per user and until the total number of entries for the competition has been reached. Entrants using the free entry method must submit each entry individually. Bulk entries, if received, will not be accepted and will only count as a single entry. Entry limitations may be imposed if the competition reaches its maximum entry capacity. Entries cannot be submitted on behalf of another person.

3.6. To enter the competition online:

(a) Visit the Site and view the Competition Question.

(b) Select your answer to the Competition Question and the desired number of entries.

(c) Complete the checkout process and submit the online registration form.

(d) Finalise the payment to receive your order confirmation.

(e) You may repeat this process as often as you wish, up to the maximum number of tickets permitted per Entrant, or until all available tickets have been allocated. Only one account is allowed per Entrant. Entrants found entering with multiple accounts or using proxies (friends and family) to enter on their behalf will be disqualified and may face a permanent ban.

3.7. All entries must be submitted in the English language. Entries in any other language will be automatically disqualified, and no refund will be provided.

3.8. Unless you are using the free entry method, the Organiser will send confirmation of your entry receipt, along with your allocated ticket number(s).

3.9. The Organiser will not be held responsible for competition entries that are not successfully completed, are lost, or are delayed due to any reason, including, for example, any failure of equipment, technical malfunction, systems, satellite, network, server, computer hardware, or software.

3.10. By purchasing entries and submitting a competition entry, you are entering into an agreement with the Organiser and agree to be bound by these terms and conditions.

3.11. You can enter the competition for free by post, provided you adhere to the following conditions:

(a) Send your entry on an unenclosed picture postcard by post to the Organiser at this address: GAINGRIND LIMITED, 124 City Road, London, EC1V 2NX, United Kingdom.

(b) Entries delivered by hand will not be accepted and will not be included in the random draw.

(c) Include the following information with your entry:

(i) Your full name.

(ii) Your residential address.

(iii) A contact telephone number and email address.

(iv) The name of the Competition you are entering and your answer to the Competition Question.

(v) Confirmation of your agreement to these Terms & Conditions.

(vi) A unique identifier on each entry. For example: [date][initials]#1, [date][initials]#2, etc.

(d) Incomplete or illegible entries will be disqualified.

(e) You may submit multiple free entries for any competition (up to any entry limit set by the Organiser), but each free entry must be submitted and mailed to the Organiser separately. Bulk entries in one envelope will not be treated as multiple entries; if a bulk entry is received, it will be counted as a single entry.

(f) By entering the competition, you confirm that you meet the eligibility criteria and accept these terms and conditions.

(g) Your entry must be received by the Organiser before the End Date. Entries received after the End Date will not be entered into the random draw. Proof of postage does not guarantee your inclusion in the random draw.

(h) The Organiser will not acknowledge receipt of your entry or confirm the correctness of your answer to the Competition Question.

(i) If the entry limit is reached before your free entry is received, you will not be included in the random draw.

(j) Entrants must have an existing account on the Site for their free entry to be processed. This account must have been logged into during the competition period. All provided details MUST match the details on the account. Postal entries received without a registered account cannot be processed.

(k) The information on the postcard must be handwritten by you. Entries written on behalf of someone else will not be accepted.

4. Selecting a Winner

4.1. All Entrants who correctly answer the Competition Question will be entered into a draw, and the winner will be selected through a random drawing process. This draw will take place as soon as reasonably feasible and, in any event, within 7 days following the End Date (the “Draw Date”).

4.2. The names and entry numbers of all Entrants will be included in a spreadsheet, which may be published on the Site and potentially visible during the live draw. If you prefer not to have your name included in this spreadsheet, you must contact the Organiser via email at info@gaingrind.co.uk as soon as possible after submitting your entry, and in any case, at least 48 hours before the live draw.

5. Eligibility Requirements

5.1. The competition is open to all residents of the United Kingdom and Northern Ireland (excluding Jersey and Guernsey) aged 18 years or over, except for:

(a) Employees of the Organiser.

(b) Employees of agents or suppliers of the Organiser who are professionally connected with the competition or its administration.

(c) Immediate family members or individuals residing in the same household as those mentioned in (a) and (b) above.

5.2. By entering the competition, you affirm that you are eligible to participate and claim any prize you may win. The Organiser may require you to provide evidence of your eligibility to enter the competition and claim the prize. Failure to provide such proof or other requested information within a reasonable timeframe may result in your disqualification.

5.3. The Organiser will not accept competition entries that are:

(a) Generated automatically by computer.

(b) Incomplete.

5.4. The Organiser reserves the complete right to disqualify you if your conduct violates the spirit or intent of the prize competition. This includes any rude or abusive behaviour towards the Organiser or anyone associated with them.

5.5. Subject to clause 11.3 below, entry fees are non-refundable under any circumstances, including:

(a) If, after entering the competition, you discover that you are not eligible to participate or claim the Prize.

(b) If, following your entry, the eligibility criteria for the competition or Prize change, and you no longer qualify.

(c) If you are disqualified from the competition by the Organiser for any reason.

5.6. If the Entrant engages in:

(a) Any form of fraud (actual or apparent).

(b) Fraudulent misrepresentation.

(c) Fraudulent concealment.

(d) Hacking or interference with the proper functioning of the website.

(e) Modifying or unauthorised use of any code comprising the website.

all their entries will be declared invalid, no refunds will be issued, and they may be banned from participating in any future competition.

6. The Prize

6.1. The prize for each competition is detailed on the Site (the “Prize”). The Prize details are, to the best of the Organiser’s knowledge, information, and belief, accurate as of the Start Date.

6.2. Prizes are subject to availability. The Organiser reserves the right to substitute any prize with one of equal or greater value. If any Prize details change, the Organiser will endeavour to update the Site as soon as reasonably practicable.

6.3. The Organiser makes no representations and offers no warranties regarding the Prize, its value, condition, or any other information provided on the Site. The Organiser does not guarantee the accuracy, completeness, or timeliness of the information on the Site. If the Prize is a vehicle:

(a) The Organiser will, unless stated otherwise, ensure it has a valid MOT certificate (if required).

(b) Insurance is not included with the Prize, and it is the Winner’s responsibility to ensure the vehicle is adequately insured before using it on public roads (if legally permissible).

(c) The Organiser assumes no responsibility for the Prize(s) once delivered. The Winner is solely responsible for complying with all relevant laws and regulations concerning the Vehicle, its operation, and ensuring its safe and responsible use.

(d) Vehicle/road tax is not included.

(e) The Winner is solely responsible for ensuring they possess and use all necessary safety equipment and attire (e.g., helmets, boots, and gloves) while operating the vehicle.

6.4. The Prize may be provided by a third-party supplier (the “Supplier”). Details of the Supplier (if applicable) will be available on the Site.

6.5. The Organiser reserves the right to substitute the Prize with a cash alternative (the “Cash Prize”) under the following circumstances:

(a) The Prize becomes unavailable.

(b) Other circumstances beyond the Organiser’s reasonable control necessitate such a substitution.

6.6. The prize is non-negotiable and non-transferable.

7. Winners

7.1. The Organiser’s decision is final, and no correspondence or discussion will be entered into.

7.2. The Winner’s full name will be announced during the live draw. If you wish to have your name censored during the live draw, please contact info@gaingrind.co.uk with sufficient time before the prize draw takes place.

7.3. The Organiser will contact the winner personally as soon as reasonably possible after the Draw Date using the telephone number or email address provided with the competition entry. If the winner cannot be reached, is unavailable, or fails to claim the Prize within 21 days of the Draw Date, the Organiser reserves the right to offer the Prize to an alternative Entrant (the “Alternate Winner”) selected randomly using the same method as before from the remaining correct entries received before the End Date. The Alternate Winner will have 21 days from notification of their status by the Organiser to communicate their acceptance of the Prize. This process will continue until a winner accepts the Prize.

7.4. The Organiser is required to either publish or make available information indicating that a valid award took place. To fulfil this obligation, the Organiser will publish the full name and county/town of residence of major prize winners on the Site.

7.5. If you object to the publication or availability of any or all of your surname, county/town of residence, and winning entry, please contact the Organiser at info@gaingrind.co.uk before the End Date. In such cases, the Organiser must still provide the information to the Advertising Standards Authority upon request.

8. Claiming the Prize

8.1. The Prize must be claimed personally by the Winner. It cannot be claimed by a third party on your behalf. Details regarding the delivery (or collection arrangements) of the Prize are provided on the Site or are available upon request.

8.2. If your personal details, including contact information, change at any time, you should promptly notify the Organiser via email at info@gaingrind.co.uk. Notifications must include details of the competition you entered, your old details, and your new details. If your details change within 10 days of the End Date, the Organiser will use your old details for contact purposes.

8.3. Any Cash Prize will be directly transferred to the winner’s nominated bank account. The winner must provide evidence that they are the sole or joint beneficiary of the account. Failure to do so within 14 days will result in disqualification and forfeiture of the prize. In such circumstances, the Organiser reserves the right to offer the prize to the next eligible Entrant selected from the correct entries received before the End Date.

8.4. The Organiser accepts no responsibility and is not liable for any compensation if you are unable to or do not take up the prize.

8.5. If the Prize is a vehicle and the winner has completed all eligibility checks, the prize will be transferred using the vehicle’s V5 document. This transfer must be completed before the vehicle is handed over.

9. Limitation of Liability

To the extent permitted by law, the Organiser, its agents, or distributors will not under any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury, or death occurring as a result of taking up the prize, except where caused by the negligence of the Organiser, its agents, or distributors, or their employees. Your statutory rights remain unaffected.

10. Data Protection and Publicity

10.1. By entering the competition, you consent to any personal information provided with your entry being held and used solely by the Organiser or its agents and suppliers for the purpose of administering the competition or as otherwise outlined in the Organiser’s Privacy Policy, which is available on the Site.

10.2. If you are the competition winner, you agree that the Organiser may use your name, image, and town or county of residence to announce the winner. You also agree to participate in any reasonable publicity requested by the Organiser.

10.3. If you do not wish to participate in any publicity, you must inform the Organiser before the End Date. This will not affect your chances of winning the Prize. If you decline to participate in publicity about the competition, we may still provide your details to the Advertising Standards Authority as legally required to demonstrate the proper administration of the competition and prize awarding.

10.4. If you win the competition, you may be required to provide further personal information and proof of identity to confirm your eligibility to claim the Prize and facilitate its transfer to you. You consent to the use of your information in this manner. You have the right to request details about how your personal information is being used. You may also withdraw your consent to such use, but doing so may prevent the Prize from being transferred to you, resulting in your withdrawal from the competition and forfeiture of the Prize without any entry fee refund. The Organiser reserves the right to offer the Prize to the next eligible Entrant from the correct entries received before the End Date.

10.5. Please note that under data protection laws, you have the right to request that the Organiser refrains from contacting you and removes your details from its database. Making such a request will constitute your withdrawal from the competition, as we will be unable to contact you if you are the winner. No entry fee refund will be provided upon withdrawal. If you do not want your personal details used for promotional purposes by the Organiser, please email [Your Contact Email Address] before the End Date.

11. General Provisions

11.1. The Organiser reserves the right to amend these terms and conditions periodically. The most recent version will be accessible on the Site.

11.2. If there is reason to suspect a breach of these terms and conditions, the Organiser may, at its sole discretion, exclude you from participating in the competition and any future competitions.

11.3. The Organiser reserves the right to void, suspend, cancel, or amend the prize competition where necessary due to circumstances beyond its control. In such cases, any entry fees paid will be refunded.

11.4. There is no minimum entry requirement, and the Organiser will not void, suspend, cancel, extend the End Date, or amend the prize competition due to insufficient entries. The draw will proceed, and the Prize will be awarded regardless of the number of entries received.

11.5. The competitions on the Site are in no way sponsored, endorsed, administered by, or associated with Facebook. By entering the competitions, Entrants acknowledge that Facebook bears no liability and is not responsible for the administration or promotion of the competitions.

11.6. These terms and conditions shall be governed by and construed in accordance with English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
